These Mobile App End User License Terms (“App Terms”) are between you and Patcher LLC (“Patcher”) and apply to your use of the Patcher iOS application (the “App”). The Patcher Terms of Service, Privacy Policy, Product Safety & Installation Disclaimer, and AI Assistant Disclaimer also apply to App features and Patcher services.
1. App Store license
If you obtained the App through Apple's App Store, the App is licensed, not sold, and the license supplied through the App Store is subject to Apple's then-current Licensed Application End User License Agreement (Standard EULA) at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ unless Apple displays a Patcher custom EULA for the App.
These App Terms supplement that App Store license with Patcher-specific rules for Patcher features and services. If these App Terms conflict with Apple's Standard EULA on a matter that Apple's Standard EULA controls, Apple's Standard EULA controls that matter.
2. Patcher-specific license and restrictions
Subject to the applicable App Store license and these App Terms, Patcher grants you a limited, personal, non-exclusive, non-transferable, revocable right to use Patcher's App features for their intended consumer purpose.
You may not copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, bypass security, or create derivative works from the App except to the extent a restriction is prohibited by applicable law or permitted by applicable open-source terms.
3. Accounts, scans, purchases, safety, and AI
Your use of accounts, guest-order access, measurement/scan tools, quantity estimates, AI assistance, orders, shipping, refunds, products, and product-use information is governed by the Patcher Terms of Service and incorporated policies.
App measurements and estimates are not professional engineering or inspection certifications. AI output can be wrong and never overrides recall/stop-use notices, exact product documents, Patcher deterministic safety stops, law, utilities, public authorities, or emergency instructions.
4. Privacy and permissions
Patcher's Privacy Policy describes App data practices. Raw measurement capture data remains on-device by default unless you choose a feature that uploads data.
Location is optional for shipping-ZIP derivation and manual ZIP entry remains available. Patcher does not require background location for that function.
Before the App sends your content to a third-party AI provider for an AI feature, Patcher will provide the applicable disclosure and request permission as described in the Privacy Policy.
5. Maintenance and support
Patcher is responsible for any maintenance and support services Patcher elects or is legally required to provide for Patcher-specific functionality. Apple is not responsible for Patcher customer support, physical product fulfillment, product information, order support, refunds, or Patcher's AI features except to the extent Apple's own terms expressly provide otherwise.
For Patcher support, contact info@patcher.me.
6. Physical products
Physical products purchased from Patcher are sold under the Patcher Terms of Service, Shipping Policy, Refund & Replacement Policy, applicable product documentation, and applicable law. The App Store license does not transfer Patcher's seller obligations to Apple.
7. Third-party services and terms
You must comply with applicable third-party terms when using the App, including terms governing your Apple device, network/data service, authentication method, payment method, and other third-party services you choose to use.
8. Legal compliance
You may not use the App in violation of applicable law, sanctions, export restrictions, or government restrictions. You represent that you are not prohibited by applicable United States law from receiving or using the App.
9. Termination
Patcher may terminate or suspend your Patcher-specific App access for material breach, fraud, security abuse, unlawful use, or where required by law. When your license or access ends, you must stop using affected App functionality.
Termination does not eliminate rights or obligations that by their nature survive, including completed-order obligations, refunds, privacy requests, product-safety communications, dispute provisions, and legally required record retention.
10. Relationship to disputes and warranties
Software/informational warranty disclaimers, physical-product warranty treatment, limitations of liability, and dispute resolution between you and Patcher are stated in the Patcher Terms of Service to the extent applicable and enforceable.
Nothing in these App Terms eliminates a consumer right that applicable law says cannot be waived.
